Where does New Jersey law stand regarding marijuana possession?

These days, marijuana possession laws vary a great deal from state to state. Today, we’ll discuss the current state of marijuana possession law here in New Jersey.

Medical marijuana possession

New Jersey is among the states that have legalized medical marijuana. There are various rules regarding what constitutes valid medical marijuana possession in the state. This includes rules on what a person needs in order to possess medical marijuana and rules limiting how much medical marijuana a person can possess for medical purposes.

So, state criminal charges can still be possible in connection to medical marijuana possession here in New Jersey if a person is accused of running afoul of these rules.

Recreational marijuana possession

There are currently legislative efforts underway to try to legalize certain recreational possession of marijuana in the state. However, they have not yet led to a law change. So, currently, possession of any amount of recreational marijuana is against state law here in New Jersey.

What a person could face in connection to allegations of possessing non-medical marijuana depends on how much they are alleged of possessing. For example, when it comes to prison time, a conviction of possession of under 50 grams of marijuana can lead to up to six months, while being convicted of possessing over 50 grams can lead to up to 18 months.

So, as one can see, facing allegations of recreational marijuana possession here in New Jersey remains something that could have major implications for a person’s future.
