New Jersey man charged with drunk driving

A man accused of driving under the influence of alcohol is in custody in Cranford, according to the local police department. The 43-year-old man from Red Bank, New Jersey, was arrested on Sept. 17 after a crash that involved two vehicles. The man was issued multiple motor vehicle summonses for his alleged infractions, including a charge of drunk driving. No court date has been publicly announced at this time, but one has been planned. 

According to the limited information provided by the report, police in Cranford responded to reports of a crash in an intersection. It appears that two vehicles were involved, one driven by the 43-year-old man. An on-scene investigation ensued, during the course of which the man was arrested for driving while intoxicated. 

Police say they attempted to subject the man to a breath test, which he apparently refused. He was arrested and, in addition to the DUI charges, was charged with careless driving, delaying traffic, obstructing traffic and refusal to submit to the breath test. If he is found guilty, he could face prison time, the loss of his license and other criminal censure. 

However, drunk driving is not always an easy charge to prove in a criminal court setting. New Jersey prosecutors are tasked with proving beyond reasonable doubt that the man's blood alcohol level was above the legal limit of .08 at the time of the accident.
